Key information in brief

  • MilitariaRadar is a search engine for listings of collectible militaria published by independent online shops from Poland and other European countries.
  • We do not sell items, we do not act as an intermediary in payments and we do not charge commission. You conclude the purchase contract directly with the shop, on its terms.
  • For each listing we show only a summary: the title, the price, one reduced-size thumbnail of a photo, an excerpt of the description (up to 300 characters) and a link. The information on the shop’s website is binding.
  • Prices in other currencies are an approximate conversion at the average exchange rate of the National Bank of Poland (NBP).
  • We automatically exclude listings marked by the shop as replicas or copies, but we do not examine the authenticity of items and we do not issue expert opinions.
  • We present historical items, including those bearing totalitarian symbols, solely for collecting and educational purposes.
  • Use of the service is free of charge and does not require creating an account.
  • You can report illegal content, infringements of rights and errors in listings to kontakt@militariaradar.pl.

This summary is intended to make reading easier and does not replace the provisions of the Terms of Service.

  5. The Terms of Service consist of a general part (§ 1–22), terms for Dealers (§ 23–26) and final provisions (§ 27–28). The general part also applies to Dealers, unless the terms for Dealers provide otherwise.

§ 3. Role of the Operator and nature of the Service

  1. The Service is a search engine and catalogue of listings of collectible militaria published by independent Shops from Poland and other European countries. The Service collects selected Listing Data, organises it, makes it searchable and refers the User to the Listing’s page in the Shop.
  2. The Operator:
    1. is not the seller or owner of the Items, does not store them and does not have them in its possession;
    2. is not a party to contracts concluded between the User and a Shop and does not act as an intermediary, agent or representative of a Shop or of the User;
    3. does not accept payments, does not act as an intermediary in payments and does not charge commission on transactions;
    4. is not an appraiser — it does not examine, value or certify Items.
  3. Listing Data is provided for information purposes. It does not constitute an offer or an invitation to conclude a contract with the Operator within the meaning of the Civil Code. Only the content of the Listing and the terms presented by the Shop on its website are binding. In the event of any discrepancy between the Listing Data and the information in the Shop, the Shop’s information prevails.
  4. The content of Listings, including photos, descriptions, titles, prices and markings of Items, originates from the Shop that published it, and that Shop is responsible for it. The Operator is not the author of this content. The Operator interferes with it only technically: it shortens the description, reduces the size of the photo, classifies it automatically, translates the title and the description excerpt and converts the price.
  5. The Service is not intended for presenting firearms or ammunition. If such a Listing appears in the Service as a result of automatic data collection, the Operator removes it once it is detected or reported.

§ 4. Types and scope of the Services

  1. The Operator provides the following Services free of charge:
    1. search engine and catalogue of Listings — searching, filtering and sorting Listing Data and browsing categories, Listing Pages and Shop profiles;
    2. going to the Shop — redirecting the User to the Listing’s page in the Shop;
    3. currency selection — presenting prices converted into PLN, EUR or USD and remembering the selected currency;
    4. handling reports, enquiries and complaints submitted by electronic means;
    5. the Account, together with Watched Listings, Saved Searches and Alerts — from the date on which these features are made available in the Service;
    6. presentation of Shops’ Listings — a service provided to Dealers on the terms set out in § 23–26.
  2. Use of the Services listed in clause 1 points 1–3 does not require creating an Account or providing personal data. Handling a report, enquiry or complaint requires an e-mail address for the reply.
  3. The Operator may develop, change or withdraw individual features of the Service, in particular for technical, legal or organisational reasons. The Operator gives advance notice, in accordance with § 27, of any change that materially and adversely affects the use of the Account.
  4. The Operator does not charge Users any fees. The User bears the costs of the Internet connection according to their provider’s tariff.
  5. The Service does not contain paid promotion of Listings. If the Operator introduces sponsored content or advertisements, it will clearly label them as advertising.

§ 5. Technical requirements and security

  1. Using the Service requires a device with Internet access and an up-to-date web browser (e.g. Chrome, Firefox, Safari or Edge in a version supported by its manufacturer) that supports encrypted connections (HTTPS).
  2. Remembering the selected currency and using the Account and forms requires cookies to be enabled in the browser. Some auxiliary features may require JavaScript to be enabled.
  3. Using the Account and Alerts requires an active e-mail address.
  4. Information about cookies and other data stored on the User’s device is contained in the Privacy Policy.
  5. Using the Internet involves typical risks, such as malware, phishing, account takeover and online commerce fraud, including fake shops impersonating genuine ones. Before making a purchase, it is advisable to check the website address and the seller’s details, use secure payment methods, exercise caution when making advance payments to foreign bank accounts and use a unique password for the Account. The Operator never asks for your password or payment card details.

§ 6. Conclusion and termination of contracts

  1. The contract for the provision of the Services referred to in § 4(1) points 1–3 is concluded when the User opens any page of the Service and terminates when the User stops using the Service. By using the Service, the User undertakes to comply with the Terms of Service.
  2. The contract for handling a report, enquiry or complaint is concluded when it is sent and terminates when the matter is closed.
  3. The contract for maintaining an Account is concluded for an indefinite period upon confirmation of registration (clicking the activation link), after acceptance of the Terms of Service. The User may terminate it at any time, without giving reasons and at no cost, by deleting the Account in the settings or by sending a statement to kontakt@militariaradar.pl.
  4. The Operator may terminate the contract for maintaining an Account with 14 days’ notice only for important reasons, which are:
    1. permanent cessation of the provision of the Services or of the Account feature;
    2. a breach of the Terms of Service by the User which the User has not remedied despite being requested to do so;
    3. no login to the Account for 24 months;
    4. a change in the law or a decision of an authority which makes it impossible to provide the relevant Service in its current form.
  5. The Operator may terminate the contract for maintaining an Account with immediate effect if the User flagrantly breaches the Terms of Service or the law, in particular provides Illegal Content, takes actions that threaten the security of the Service or of other persons, has registered the Account using another person’s data without their authorisation, or uses the Service in the manner described in § 12(4).
  6. The Operator informs the User of the notice of termination or the termination of the contract by e-mail sent to the address assigned to the Account and provides a statement of reasons (§ 17).
  7. If the provisions of the Polish Act of 30 May 2014 on Consumer Rights (ustawa o prawach konsumenta) grant a Consumer the right to withdraw from the contract for maintaining an Account, the Consumer may withdraw from it within 14 days of its conclusion without giving reasons, by sending a statement to kontakt@militariaradar.pl or by deleting the Account. The Account is free of charge, so withdrawal does not involve any costs.

§ 7. Account and e-mail alerts

The provisions of this section apply from the date on which the Account feature is made available in the Service.

  1. An Account may be created only by an adult natural person with full legal capacity.
  2. Registration requires providing an e-mail address, setting a password, accepting the Terms of Service and confirming the e-mail address by clicking the activation link. Accounts not confirmed within 30 days are deleted.
  3. The User provides an e-mail address to which they have access, does not share their password with other persons and promptly informs the Operator of any suspected unauthorised access to the Account.
  4. Within the Account, the User may:
    1. add Listings to the list of Watched Listings and save private notes on them;
    2. save search criteria as Saved Searches;
    3. enable Alerts, i.e. e-mail notifications about new Listings matching a Saved Search and about changes in the price or status of a Watched Listing.
  5. Alerts are auxiliary in nature and are sent according to the schedule for checking Shops, which means a delay relative to changes in the Shop. The Operator does not guarantee that an Alert will arrive before the Item is sold, that it will cover all matching Listings or that it will not be stopped by a spam filter. Listings collected when a new Shop is first connected are not covered by Alerts.
  6. Alerts are part of a Service ordered by the User and do not constitute commercial information. Each Alert contains a link to switch off the given notification. The Operator may send commercial information, e.g. a newsletter, only with separate consent.
  7. Notes on Watched Listings are visible only to the User and are not published. They may not contain Illegal Content.

§ 8. Where Listing data comes from

  1. Listing Data is collected automatically by the Robot from publicly available Shop websites or from files and interfaces made available by Shops (e.g. an XML product feed, a shop platform interface), or is provided by the Shop.
  2. The Operator publishes Listing Data only of those Shops which have consented to its presentation, and only within the scope of that consent (§ 23).
  3. The Robot identifies itself by the name MilitariaRadarBot together with a contact address, complies with the robots.txt file and limits the frequency of requests. The Robot does not circumvent logins, CAPTCHA-type protections or other blocks.
  4. The Robot usually checks new Listings daily and other Listings every few days. Listing Data may therefore differ from the current state in the Shop. The date of the last check is shown next to the Listing.
  5. A Shop may at any time withdraw its consent or request the removal of its Listings (§ 25).

§ 9. Prices and currency conversion

  1. Each Listing shows the price stated by the Shop in its currency (the “Shop price”). If there is no price in the Shop, there is no price in the Service.
  2. At the User’s request, the Service converts the Shop price into PLN, EUR or USD at the average exchange rate of the National Bank of Poland from Table A; conversion between EUR and USD is made via PLN. A converted price is marked with the “≈” sign and is accompanied by the date and number of the exchange rate table.
  3. The conversion is for guidance only. The amount actually paid depends on the currency and terms of the Shop, the exchange rate applied by the bank, card issuer or payment operator, commissions, shipping and insurance costs, customs duty, taxes (including VAT on imports from outside the European Union) and other charges. Prices in the Service may not include these costs.
  4. Exchange rates are updated on business days after their publication by the NBP. Until the update, the latest available rate is applied.
  5. For sold or unavailable Listings, the Service may show the Shop’s last asking price. This is not the price at which the Item was sold.
  6. Information about a price change, including in Alerts, describes a price change observed by the Robot on the Shop’s website. It is not an announcement of a price reduction or promotion by the Operator.

§ 10. Up-to-dateness, availability and display order of Listings

  1. The Service determines the status of a Listing (available, reserved, sold, unavailable or undetermined) automatically on the basis of the markings on the Shop’s website. The status “sold” is assigned only if the Shop has clearly marked the Listing as sold.
  2. If the Shop’s website does not respond for some time or its structure has changed, the Service marks the Listing Data as out of date and may hide it until a successful check.
  3. The main parameters determining the order in which Listings are displayed in search results are as follows:
    1. relevance to the query — first, matching of markings, item type and manufacturer, then of title and category, and finally of description;
    2. where relevance is similar, available and recently checked Listings are displayed higher;
    3. in the “New” view, Listings are ordered by the date on which they first appeared in the Service;
    4. the User may change the sorting, e.g. by price or date; sorting by price uses currency conversion, so the resulting order is approximate.
  4. Reserved and sold Listings are hidden from the results by default or displayed after available Listings.
  5. The order of Listings is not affected by fees or other benefits provided to the Operator.
  6. The Service does not cover all listings available on the market or all listings of a given Shop.

§ 11. Replicas, authenticity and automatic classification

  1. Listings which the Shop has marked as a copy, replica, reproduction or in a similar way (in various languages), as well as Listings from Shop sections intended for replicas, are automatically excluded from publication. Listings raising doubts are withheld pending the Operator’s decision.
  2. The mechanism described in clause 1 is based solely on the markings and structure of the Shop’s website. It is not an examination, an expert opinion or a confirmation of authenticity. The presence of a Listing in the Service does not mean that the Item is original, complete, in the condition described or consistent with its description.
  3. Categories, item types, manufacturers, markings (e.g. LDO or RZM codes), period and country of origin are assigned automatically on the basis of the content of the Listing. They may be incorrect or incomplete and do not constitute an expert opinion. Translations of titles and description excerpts are machine translations.
  4. Before making a purchase, the User should independently verify the authenticity, condition and provenance of the Item, in particular with the Shop and, if necessary, with an independent expert.
  5. A replica or an error in Listing Data may be reported under the procedure set out in § 16.

§ 12. Historical items and totalitarian symbols

  1. The Service presents historical items, including items from the period of the Third Reich and other totalitarian systems, which may bear fascist, Nazi, communist or other totalitarian symbols. These items are presented solely as part of collecting and educational activity and for the purpose of documenting history, within the meaning of Article 256 § 3 of the Polish Criminal Code (Kodeks karny).
  2. The Operator does not promote or approve of any totalitarian system or any ideology inciting hatred. The presentation of an item does not mean approval of the ideas with which it is associated.
  3. The Operator may exclude or remove Listings and content which, in its assessment, go beyond the collecting or educational purpose, in particular contemporary items and gadgets bearing totalitarian symbols, contemporary propaganda materials and content glorifying or inciting hatred.
  4. It is prohibited to use the Service, including the Account, queries, notes and reports, to promote a totalitarian system or to incite hatred.
  5. The acquisition, import, possession and public display of items bearing totalitarian symbols, edged weapons, decorations and items of cultural heritage are subject to different restrictions in different countries (including Germany, Austria and France). The User is responsible for checking and complying with the laws in force in the place where they use the Service and in the country of delivery, including customs regulations and regulations on the export of items of cultural heritage.

§ 13. Purchases in Shops

  1. The “Go to shop” button takes the User to the Listing’s page in the Shop. From that moment, the User uses the Shop’s website on the Shop’s terms, including its terms and conditions and privacy policy.
  2. The User concludes the contract concerning the Item with the Shop. The Shop is responsible for the performance of that contract, payments, delivery, conformity of the Item with the contract and the description, complaints, guarantee, withdrawal from the contract and returns.
  3. Complaints and claims concerning Items and transactions should be addressed to the Shop; the Operator does not handle them. The User may report a dishonest Shop to the Operator under the procedure set out in § 16, and the Operator may suspend the presentation of its Listings.
  4. The link to the Shop may contain a parameter informing the Shop that the User came from the Service (e.g. utm_source=militariaradar). The Operator does not pass Users’ personal data to Shops.
  5. The Consumer’s rights vis-à-vis the Shop depend on the law applicable to the contract with the Shop; different rules may apply to purchases from Shops in other countries. It is advisable to read the Shop’s terms before making a purchase.

§ 14. Rules for using the Service and prohibition of unlawful content

  1. The User uses the Service in accordance with the law, the Terms of Service and good practice.
  2. The User is prohibited from providing content of an unlawful nature, including in queries, notes, reports and messages. This applies in particular to content which promotes a totalitarian system or incites hatred, infringes personal rights, copyright, database rights or trade mark rights, discloses other persons’ personal data without a legal basis, is misleading, constitutes spam or contains malware.
  3. The following are also prohibited:
    1. disrupting the operation of the Service, including overloading it, attacking it and scanning it for vulnerabilities;
    2. circumventing the security measures and technical restrictions of the Service;
    3. systematically extracting or re-utilising a substantial part of the Listing Data, catalogues, dictionaries and other resources of the Service without the Operator’s written consent, except for indexing by internet search engines in accordance with the Service’s robots.txt file;
    4. impersonating the Operator, a Shop or another person;
    5. submitting reports or complaints in a manifestly unfounded manner or for the purpose of harassment.
  4. In the event of a breach of clause 2 or 3, the Operator may remove the content, block access to the Service from a specific source, suspend the Account or terminate the contract in accordance with § 6, giving notice of this in accordance with § 17.

§ 15. Intellectual property

  1. Photos, descriptions, titles, names and trade marks contained in Listings belong to Shops or third parties. The Service presents them to a limited extent (one reduced-size Thumbnail and a description excerpt of up to 300 characters), indicating the Shop as the source and with a link to the Listing. This is based on the Shop’s consent and, to the extent permitted by law, also on permitted use, including the right of quotation (Article 29 of the Polish Act on Copyright and Related Rights (ustawa o prawie autorskim i prawach pokrewnych)). Full photos and descriptions are available only in the Shop.
  2. The graphic layout of the Service, the logo, the software, the Operator’s texts, dictionaries and classifications, and the database of the Service as a whole are protected by law, including copyright and database protection laws. Using them beyond permitted personal use requires the Operator’s consent.
  3. A person whose rights have been infringed may report this under the procedure set out in § 16. Upon receiving a credible report, the Operator promptly removes the indicated content or disables access to it.

§ 16. Reporting illegal content and infringements of rights

  1. Anyone, including a person who does not use the Service, may report to the Operator content available in the Service which they consider to be Illegal Content, to infringe their rights (e.g. copyright, image rights, personal rights, rights relating to personal data, trade marks or databases) or to be inconsistent with the Terms of Service (e.g. a replica, a firearms Listing, propaganda content, a Listing of a dishonest Shop). An error in Listing Data may be reported under the same procedure.
  2. Reports are accepted by electronic means at kontakt@militariaradar.pl (subject line: “Content report”) or via a form or the “Report” button in the Service, if made available.
  3. A report should contain:
    1. a sufficiently substantiated explanation of why the reported content is illegal or infringes the rights of the reporting person or the Terms of Service;
    2. the exact web address (URL) of the content and, where necessary, additional information enabling it to be identified;
    3. the first name and surname or name, and the e-mail address, of the reporting person, except for reports concerning offences referred to in Articles 3–7 of Directive 2011/93/EU;
    4. a statement that the reporting person is acting in good faith and that the information and allegations contained in the report are accurate and complete;
    5. in the case of an infringement of intellectual property rights — an indication of the protected work or right and information that the reporting person is the right holder or acts on the right holder’s behalf.
  4. The Operator confirms receipt of the report to the e-mail address provided and processes it in a timely, diligent, objective and non-arbitrary manner. If the report is incomplete, the Operator may ask for it to be supplemented.
  5. After examining the report, the Operator may remove the Listing, Thumbnail or description excerpt, disable access to them, correct incorrect Listing Data, suspend data collection from the Shop or refuse to take action if the report is unfounded. While the matter is being clarified, the Operator may temporarily hide the content.
  6. The Operator informs the reporting person, without undue delay, of its decision and of the possibility of challenging it (§ 17). If automated means were used in processing the report, the Operator indicates this.
  7. The Operator may, after a prior warning, suspend for a specified period the processing of reports from persons who frequently submit manifestly unfounded reports.
  8. The Operator complies with orders of judicial and administrative authorities concerning Illegal Content and provides information in accordance with the law. The Operator informs the competent authorities of any suspected criminal offence involving a threat to the life or safety of persons.
  9. The Operator may, on its own initiative, verify and remove content that is inconsistent with the law or the Terms of Service, including by means of automated rules (e.g. detection of replica markings). In case of doubt, automated decisions are reviewed by a human.
  10. The Operator applies the mechanisms described in this section and in § 17 to the extent required by the DSA, and otherwise, mutatis mutandis, as an operating principle of the Service.

§ 17. Decisions concerning content and Accounts — statement of reasons and appeal

  1. If the Operator removes a Listing or other content, disables access to it, restricts its visibility, suspends the presentation of a Shop’s Listings or suspends or closes an Account, it provides the Dealer or User concerned by the decision (provided that it knows their e-mail address) with a clear and specific statement of reasons, at the latest when the restriction takes effect.
  2. The statement of reasons includes in particular:
    1. the type of decision, its scope and duration;
    2. the facts and circumstances on which it was based, including information on whether it results from a report or from the Operator’s own initiative;
    3. information on the use of automated means;
    4. the legal basis, if the content was considered Illegal Content, or the provision of the Terms of Service with which the content is inconsistent;
    5. information on the possibility of appeal and other means of redress.
  3. Clause 1 does not apply where providing a statement of reasons would be contrary to the law or to an order of an authority.
  4. The reporting person and the person concerned by the decision may lodge an appeal within 6 months of receiving information about the decision, at kontakt@militariaradar.pl, indicating the decision and the grounds for the appeal.
  5. The Operator considers the appeal within 14 days, not solely by automated means, and changes the decision if the appeal is justified.
  6. Irrespective of the appeal, the person concerned may use a certified out-of-court dispute settlement body, where provided for by the DSA, and may pursue their rights before a court.

§ 18. Points of contact

  1. The single point of contact for the authorities of the Member States, the European Commission and the European Board for Digital Services (Article 11 DSA) and for recipients of the service (Article 12 DSA) is the e-mail address kontakt@militariaradar.pl.
  2. Communication with the point of contact is possible in Polish and English.
  3. Messages sent to the point of contact are handled by a human, not solely by automated tools.

§ 19. Liability of the Operator

  1. The Operator is liable for non-performance or improper performance of the Services to the extent specified in the Terms of Service, on the terms provided for by law, subject to clauses 2–5.
  2. The scope of the Services is limited to presenting Listing Data collected from Shops and referring Users to Shops. To the fullest extent permitted by law, the Operator is not liable for:
    1. the content of Listings and Shops’ materials, including photos, descriptions, titles and markings, of which the Shop or a third party is the author or holder;
    2. the price, availability, condition, completeness, authenticity, provenance and legality of Items, or the truthfulness and accuracy of their descriptions;
    3. discrepancies between Listing Data and the state in the Shop resulting from changes made by the Shop after the last check of the Listing;
    4. the conclusion and performance of contracts between Users and Shops, including payments, shipping, customs duty, taxes, complaints, returns, withdrawals, guarantees, statutory warranty, and the solvency and reliability of the Shop;
    5. the operation, availability, security, content and privacy rules of Shops’ websites and other websites to which links lead;
    6. the difference between the price converted in the Service and the amount actually paid;
    7. the results of automatic classification and translations, which are auxiliary in nature;
    8. the consequences of decisions taken by the User on the basis of Listing Data without checking the information in the Shop;
    9. the compliance of the acquisition, import and possession of an Item with the law of the User’s country;
    10. interruptions and errors in the operation of the Service resulting from causes for which the Operator is not responsible (§ 20).
  3. The limitations in clause 2 do not apply to damage caused by the Operator intentionally or through gross negligence, or to personal injury.
  4. In relation to Consumers and Entrepreneurs with Consumer Rights, the provisions of the Terms of Service do not exclude or limit the Operator’s liability to the extent that this would be contrary to mandatory provisions of law, in particular Article 385³ of the Civil Code. To that extent, the Operator is liable on general principles.
  5. In relation to Users who are neither Consumers nor Entrepreneurs with Consumer Rights, the Operator’s liability in respect of the Services covers only actual loss (excluding lost profits) and is limited in aggregate to PLN 100, except for damage caused intentionally.

§ 20. Availability of the Service and interruptions in its operation

  1. The Operator makes efforts to ensure that the Service operates continuously and properly. The Services are free of charge; therefore, the Operator does not guarantee any specific level of availability, uninterrupted operation of the Service or absence of errors.
  2. Interruptions in the operation of the Service may result in particular from:
    1. maintenance work and updates, which the Operator, where possible, schedules at night;
    2. failures or work on the part of the hosting provider, telecommunications operators and other third parties;
    3. attacks on the ICT infrastructure;
    4. force majeure;
    5. the need to ensure the security of the Service or of data.
  3. The Operator is not liable for the consequences of interruptions and errors resulting from causes for which it is not responsible, including those listed in clause 2 points 2–4, or for lack of access to the Service resulting from the characteristics of the User’s device, software or connection.
  4. The Operator may discontinue the Service. The Operator informs Users holding an Account of its intention to discontinue the provision of the Account service at least 30 days in advance.

§ 21. Complaints concerning the Services

  1. The User may submit a complaint concerning the Services provided by the Operator, e.g. the incorrect operation of the Service, the Account or Alerts, or the manner in which a report was handled.
  2. A complaint may be submitted by e-mail to kontakt@militariaradar.pl.
  3. A complaint should contain the first name or name and the e-mail address of the person submitting it, a description of the problem with the date and the address of the page concerned, and the request. If the complaint needs to be supplemented, the Operator will ask for this before considering it.
  4. The Operator considers the complaint within 14 days of its receipt and sends the reply to the e-mail address of the person submitting it or, at their request, by post.
  5. Complaints concerning Items, transactions, payments, delivery and returns should be addressed to the Shop (§ 13). The Operator does not handle them.
  6. If the provisions of the Act on Consumer Rights concerning digital services apply to the contract with a Consumer, the Consumer has the rights arising from the lack of conformity of the digital service with the contract to the extent provided for therein. The Terms of Service do not limit those rights.

§ 22. Out-of-court dispute resolution

  1. A Consumer may use out-of-court methods of handling complaints and pursuing claims, in particular the assistance of a municipal or district consumer ombudsman, mediation conducted by the provincial inspector of the Trade Inspection, or a permanent consumer arbitration court. Information about these bodies is available on the website of the Office of Competition and Consumer Protection (UOKiK, uokik.gov.pl).
  2. Participation in out-of-court dispute resolution is voluntary for both parties. In its reply to a complaint that has not been upheld, the Operator states whether it agrees to out-of-court dispute resolution.
  3. Disputes concerning the decisions described in § 17 may also be resolved under the procedure set out in § 17(6).

§ 23. Terms for Dealers — consent and scope of presentation

  1. The presentation of a Shop’s Listings in the Service requires the Dealer’s consent. Consent is given by a person authorised to act on behalf of the Shop, by e-mail or via a form provided by the Operator. Giving consent constitutes the conclusion of a contract for the presentation of Listings on the terms set out in § 23–26 and the other provisions of the Terms of Service. The Operator keeps confirmation of the consent together with its date and scope.
  2. Unless the parties have agreed otherwise, the consent covers:
    1. automatic collection by the Robot of publicly available information about Listings from the Shop’s website or from a file or interface made available by the Shop, at a frequency set by the Operator (usually new Listings daily, all Listings every few days);
    2. publication in the Service of Listing Data: the title, price and currency, availability status, one Thumbnail, a description excerpt of up to 300 characters, a link to the Listing, and the name, country and web address of the Shop;
    3. creation of a Thumbnail by reducing the size of one photo from the Listing and changing the file format;
    4. automatic classification of Listings, translation of titles and description excerpts, and price conversion;
    5. use of Listing Data in Alerts, sitemaps, structured data and page previews made available to internet search engines;
    6. storage of the history of prices and statuses of Listings for the purpose of keeping statistics and presenting them in the Service;
    7. use of the Shop’s name and designation to indicate the source of Listings and on the Shop’s profile in the Service.
  3. To the extent described in clause 2, the Dealer grants the Operator a free-of-charge, non-exclusive licence, without territorial limitations, for the duration of the consent, which may be terminated at any time in accordance with § 25. The licence covers fixation and reproduction by digital technique, entering into computer memory and ICT networks, making available to the public on the Internet in such a way that anyone can access it at a place and time of their own choosing, as well as reduction, shortening and translation to the extent described in clause 2.
  4. The scope of presentation may be extended (e.g. to include additional photos) or narrowed (e.g. without Thumbnails) only by agreement with the Dealer.
  5. The presentation is free of charge. The Operator does not charge the Dealer any fees or commission on sales and does not require exclusivity or the application of specific prices. The contract for the presentation of Listings does not create a relationship of intermediation, agency, representation or partnership.
  6. The Operator complies with the robots.txt file and limits the rate of the Robot’s requests. The Dealer may indicate a preferred method of data collection (e.g. a product feed or an interface), hours or a request limit; the Operator will take them into account to the extent technically possible.
  7. The Operator may provide the Dealer with aggregate statistics on click-throughs from the Service to the Shop. The statistics do not contain Users’ personal data.

§ 24. Terms for Dealers — representations and liability for the content of Listings

  1. The Dealer represents that:
    1. it operates the Shop as an entrepreneur and is authorised to give consent on the Shop’s behalf;
    2. it holds the rights to the photos and descriptions published in the Listings or is authorised to permit their use within the scope of § 23;
    3. the Listings and Items comply with the law applicable to the Shop;
    4. replicas, copies and reproductions are clearly marked in the Shop.
  2. The Dealer is responsible for the content of Listings, including the truthfulness of descriptions, the declared authenticity and condition of Items, prices and availability, as well as for the contracts concluded with buyers and their performance.
  3. If a third party brings a claim against the Operator concerning content originating from the Shop and presented within the scope of the consent (e.g. for infringement of copyright in a photo), the Dealer will indemnify the Operator and cover reasonable costs, including amounts awarded and legal costs. This is conditional upon the Operator promptly notifying the Dealer and enabling it to participate in the matter.
  4. The Dealer promptly informs the Operator of material changes, such as a change of the Shop’s address, cessation of business or the launch of a replica section.

§ 25. Terms for Dealers — withdrawal of consent, restriction and termination of presentation

  1. The Dealer may at any time, without giving reasons and at no cost, withdraw consent, narrow the scope of presentation or request the removal of selected Listings or Thumbnails. A message to kontakt@militariaradar.pl sent from an e-mail address in the Shop’s domain or from an address given on the Shop’s website is sufficient. In case of doubt as to the sender’s authority, the Operator may ask for confirmation and suspend the presentation of the Shop’s Listings until the matter is clarified.
  2. The Operator carries out the request promptly, no later than within 3 business days of its receipt: it removes the Listings from search results, Listing Pages and sitemaps, deletes the Thumbnails and stops the Robot from collecting data from the Shop.
  3. After consent is withdrawn, the Operator may retain only the data necessary to respect the objection (e.g. the Shop’s domain on an exclusion list and technical identifiers of Listings), aggregate statistics not containing Listing Data, and backups until their routine deletion, for no longer than 30 days.
  4. The Operator is not responsible for copies of Listing Data stored by third parties, e.g. in the cache of internet search engines, or for Alerts sent before consent was withdrawn. However, the Operator marks deleted pages in a manner that informs search engines of their removal.
  5. The Operator may refuse to start presentation, restrict it or suspend it with respect to individual Listings or all Listings of a Shop, in particular where:
    1. the Listing is a replica or copy, or there are reasonable doubts in this respect;
    2. the Listing or the Shop infringes the law or the Terms of Service;
    3. the Operator has received a credible report (§ 16);
    4. the Shop blocks the Robot, requires login or JavaScript support, has changed the structure of its website, or data collection is technically difficult for other reasons;
    5. the Shop offers mainly replicas;
    6. the total number of Listings in the Service has reached the technical limit;
    7. the Shop’s profile does not match the subject matter of the Service.
  6. The Operator informs the Dealer of the restriction or suspension of presentation, together with a statement of reasons, at the latest when it takes effect (§ 17). The Dealer may provide explanations or lodge an appeal at kontakt@militariaradar.pl; the Operator considers them within 14 days.
  7. The Operator may terminate the contract for the presentation of Listings with 30 days’ notice, giving reasons. Termination with immediate effect is permitted where required by law or by an order of an authority, in the event of repeated breaches of the Terms of Service by the Dealer or the presentation of Illegal Content, and also in the event of discontinuation of the Service.

§ 26. Terms for Dealers — no guarantees, order of Listings and liability

  1. The Operator does not guarantee the Dealer any specific traffic, number of click-throughs to the Shop or sales, any specific position of Listings in the results, frequency of updates of Listing Data, presentation of all of the Shop’s Listings, continuity of operation of the Service, or the correctness of automatic classification, translations and conversions.
  2. The main parameters determining the order of Listings are described in § 10(3). The Operator applies them equally to all Shops, and the Dealer cannot improve the position of its Listings in exchange for payment.
  3. The Operator’s liability towards the Dealer for damage related to the presentation of Listings or its restriction, suspension or termination, including for lost profits and for errors in Listing Data, is excluded to the fullest extent permitted by law, except for damage caused intentionally.
  4. The Operator informs the Dealer of any change to the terms for Dealers by e-mail sent to the Dealer’s address at least 15 days before the changes take effect. A Dealer who does not accept the changes may withdraw consent at no cost before that date.
  5. The provisions of the Terms of Service intended exclusively for Consumers do not apply to the contract with the Dealer, unless the Dealer is an Entrepreneur with Consumer Rights and the law requires them to be applied.

§ 27. Changes to the Terms of Service

  1. The Operator may amend the Terms of Service for important reasons, which are:
    1. a change in the law;
    2. a court judgment, or a decision or recommendation of an authority;
    3. a change in the scope or manner of providing the Services, including the launch or withdrawal of features;
    4. a change in the Operator’s details or in the providers of technical services;
    5. the need to improve security or to prevent abuse;
    6. the need to remove ambiguities or editorial errors.
  2. The Operator announces changes in the Service and, to Users holding an Account and to Dealers, also by e-mail, at least 15 days before the changes take effect.
  3. A User holding an Account who does not accept the changes may terminate the contract for maintaining an Account at no cost before the changes take effect.
  4. The changes do not affect rights acquired before they take effect. Complaints, reports and appeals submitted before the change are considered under the previous rules.
  5. A shorter period for changes to take effect is permitted where required by law or by an order of an authority, or where the change only extends Users’ rights.
  6. The Operator makes previous versions of the Terms of Service available [w Serwisie albo na żądanie przesłane na adres e-mail Operatora].

§ 28. Final provisions

  1. Polish law applies to contracts concluded on the basis of the Terms of Service. The choice of law does not deprive the Consumer of the protection afforded to them by those provisions of the law of the country of their habitual residence which cannot be excluded by agreement.
  2. Disputes with Consumers are resolved by the court having jurisdiction under the general rules. Disputes with entrepreneurs who are not Entrepreneurs with Consumer Rights are resolved by the court having jurisdiction over the Operator’s seat.
  3. If any provision of the Terms of Service proves to be invalid or ineffective, the remaining provisions remain binding. A provision deemed prohibited (unfair) in relation to a Consumer is not binding on the Consumer, and the contract otherwise remains binding on the parties.
  4. The rules for processing personal data and using cookies are set out in the Privacy Policy.
  5. These Terms of Service apply from 5 November 2026.
